I dont know about the process of divorce in India, or the country where u got married so I cant help you with this, As I a got married in Geneva Switzerland, it was a mutual decission so had to file a legal separation first for a year ( live separately) then after a year the send me a papers to signed for the divorce then a week after we got the divorce paper without court involved. Mine wasnt complicated because it was a mutual decissions of a 2 matured adult and beside we both not greedy on things, money or anything. I gave all our conjugal things to him so i left nothing but my freedom was worth more than anything. But I think if there is strong ground for divorce it will not take so long but it also depends on the other party if she wants her share on all conjugal things then it will be difficult. Its better to agree on things first. I wish I could help you with ur questions but we live in different country, different rules we should follow. Hi I do not really know your situation but I am recently divorced by mutual constent,though my ex had filed for divorce in March **** sam emonth I reached US as we were living there he actually abandonded me so I had to file for divorce there after a long period it paid me off as he was compelled to come to a point otherwise he was trying to get away with everything though at the time of marriage he made hardly **** rs permonth and now he makes ***,*** dollars annually,I suggested that we file for divorce on mutual constent and then the divorce can be granted within a month in that case the*month perios is waived off needless to say he made me sign the petition even though a lot almost all my items were not returned ofcourse mostoff the items were my hardearned bolld and sweat even though I worked as a house wife this guy made me work and treated me worst than a slave in US inspite of the fact that before marriage I had worked as sr manager with fivestar hotels,I let him go as it was not worth to keep a relationship if there is no love left. I suggest it pays to be good after soul searching try to meet the girl and involve attorney and let it go. Ofcourse he is facing the music now as the friends help he took for the meeting place is now after him as he wronged him and his friend is not an angel like him who will let him go just like that. Moneycomes and money goes in the end if with all sincerey of your heart if you try to reach the girl I am sure you*will be able to resolve the same easily. To file a mutual divorce application, both parties have to jointly do this and of course settle for a common goal -getting a divorce so that they all can go on with thier life. This is important than the surrender of material. All the material, money (to be paid by cash or cheque) to be surrendered should be listed in the application. This helps both parties to trust the legal application. One has to have a clean deal before hand in the presence of the advocate. No fighting or finger pointing at this time. Once the mutual application is filed before the family court judge he may may not ask you if there is any chnace for you guys to live together. if you both say "NO" and say it is better for both of you to separate then the judge marks a second date (6 months from the date of filing). Before appearing in the court for the second time, you both should settle all that is written in the application. This can be done on the day of second hearing before the advocate. Then, write a joint agreement saying that you both have settled the issues regarding money etc mentioned in the applicaiton and sign the paper(could list all the money and cheque/DD details in this). This would be submitted before the Judge and he would ask you if there is any chance for living together again. If answer is NO, he would get both of you to say that under what circumsances you are asking for divorce and a steno would record all these and get your signature separately. Then based on the declaration you juts made judge would pass the court order for mutual divorce. Then he advocate would get*copies of the court order and give one each to both parties. I do not know if the panchayat system is legal anymore. Above all, you need to consult a family court lawyer who can guide better. The best thing to do is, as Neema suggested, decide to settle everything before filing the application so that you need not do anything after the divorce. this would help both parties to move on.
