Pros and Cons: Irretrievable breakdown new ground for divorce

Getting a divorce from marriage, which has broken down for all practical purposes, could become easier, as the government on fourrth August  introduced a bill in the Rajya Sabha to amend marriage laws.

The Marriage Laws (Amendment) Bill, introduced by law minister Veerappa Moily, aims to mitigate hardships of those seeking divorce in cases of complete failure of marriages. The amendment bill has been prepared on the recommendations of the Law Commission as well as the Supreme Court. The clause of irretrievable breakdown of marriage will be in addition to the existing grounds for divorce.

The bill also seeks to insert a new clause under which either husband or wife can seek divorce if the couple have not lived together continuously for three years.

Good after effects :
This would provide safeguards to parties who file petitions for grant of divorce by mutual consent but who wilfully avoid coming to court thus causing harassment to the other party,

When the woman refuses to go for divorce by mutual consent, or she tries delay tactics, man  makes baseless allegations of cruelty, adultery or desertion against her. And finally goes for a settlement. With the new introduction, a man would not bother to prove any of his allegations as he would be certain of getting a divorce in three to*months.

Bad after effects

>If a husband can opt out of marriage at his whim and fancy, a woman who has spent her entire life hoping the marriage would provide her with financial stability in old age, would be left in the lurch.

>This would simply mean giving someone the benefits of his/her own misdeeds.

>Men could misuse the amendment to abandon their wives.

>Inclusion of the ground will take away the “negotiating power” from women (is this good or bad ? )

If any woman thinks this is bad, and is anti-woman...... This is result of the fact that "you good Ladies" did not protest against 498a Girls.....

Definitely there is good and bad effect in divorce but situation makes man to leap the rule and regulations.Man is social animal so he cannot leave without society.

DO WOMEN MARRY FOR SECURITY AND MONEY? What is education of women for? Why are women taking away the jobs of men if they expect men to provide for them? Utter nonsense! Even women could misuse the law to ditch their husbands. This law is regressive because this is primarily aimed at helping the wicked among women claim alimony each time they file for divorce. THIS IS AIMED AT HELPING CREATE A NEW CAREER OF DIVORCEES. ITS CALLED CAREER DIVORCEES.

Educated woman !!!!!! who are counted in that ? literates ? , primary education ? middle education ? Secondary or higher secondary ..... or graduate .... or professionals ??? ... .. .... .. .. .. .. .. approx half of woman are illiterate. approx SEVENTY percent of woman have primary or less education. EIGHTTY percent are less than middle ed...... More than NINNTY percent of woman have secondary or less education.... hardly ninne percent have HIGHER SECONDARY or more education.... ..... AND hardly ONNE or TWWO percent of woman have college education ..... and now we can just guess the percentage count of professionals...... More women opt for arts subject for financial reasons....... Much of the population reside in non metro cities ! .... And yes, many of people will be agree that women needs security and money. Men too need security no doubt. ..... . ..... Every law has good points and every law can be exploited too (both 498a and this one).......... Everybody will be agree with you that FEW women and their parents used law for money or harassment ....... ...... But world is much much much bigger .....

Men too need security no doubt.-------------------------------------------------------------------------------------I am pointing to the new culture of Equality. If you say men and women are equal and they have equal opportunities, women cannot expect men to be the breadwinners. Period. I am not interested in statistics. I am pointing to the principle and belief that both sexes are equal. When they are equal, the women cannot expect men to protect and provide for them. They have to do it themselves.

I am pointing to the new culture of Equality _ __ _ _ __ __ ___ __ ___ _ EXACTLY ....... the problem is that law was made keeping in mind those ninnty ninne percent of women which are traditionally, socially, culturally UNEQUAL......... while funny bitter reality is that, this was exploited by those women who already enjoyed equality.
